These Terms and Conditions govern Giftwrap UK ("GUK") performance relating to the sale and supply of goods to the customer. GUK reserve the right to amend these terms and conditions from time to time by updating this text page; and the customer is bound by any such modifications or revisions.
2. Contract with customer
The contract between GUK and the customer comes into existance upon GUK acceptance of the customers order i.e. when payment has been received. GUK is entitled to withdraw from contracts in the case of obvious typographical or arithmetical inaccurances appearing on the GUK website.
3. Pricing and Availablity
The prices of the goods are those specified on the GUK website. The price, as displayed, is exclusive of VAT (at the standard UK rate). There will be an additional charge for delivery unless stated otherwise. Orders are subject to availability. In the unlikely event that the goods are unavailable, the customer will be notified by e-mail. Price and availablity information is subject to change without notice.
4. Delivery of Goods
GUK will deliver the goods ordered to the delivery address supplied by the customer. Availablity permitting, all orders paid for will be delivered within 4-5 working days. Goods that are out of stock can take 3-4 weeks to deliver. GUK is entitled to deliver in part. Despatch of goods constitutes fulfilment of contract.
5. Damaged Goods
Any faulty, damaged goods or shortages must be notified within 24 hours of delivery, failure to do so will result in refusal of returned goods and no refund.
6. Return of Goods
If for any reason the customer is unhappy with their purchase, they can return it to GUK for an exchange or refund, providing GUK receives it within 7 days from the date of its original receipt by the customer. Returned products must be received by GUK in good condition and all component parts, including any promotional products that may have been included in your purchase. A note explaining the reason for return should also be enclosed. This does not affect your statutory rights. The customer bears the cost of returning goods for refund or exchange, except in cases of faulty, damaged or wrongly supplied goods. (GUK requests that you use registered post or recorded delivery when returning goods and that proof of postage is retained).
7. Governing Law and Jurisdiction
Contracts between GUK and the customer will be governed by English Law and all disputes will be submitted to the non-exclusive jurisdiction of the English courts.
GUK hereby, to the fullest extent permitted by law, disclaims all warranties and conditions with regards to the material and any goods and servise supplied in relation to this website, whether expressed or implied or statutory (including all implied warranties and conditions of the merchant ability and fitness for a particular purpose). In no event that GUK be liable for any indirect, punitive, special, incedental or consequential damages whatsoever even if GUK has been advised of the possibility of damages including, without limitation, damages for loss of use or performance of this website, interruptions or delays to this website, the provision of or failing to provide services, or for any information, material, goods and services obtain through this website or otherwise arising out of the use of this website, whether based on contract, tort or otherwise to the fullest extent permitted by law.
9. Invalidity of Terms & Conditions
If for any reason part of these Terms & Conditions is unforceable; the validity of the remaining Terms & Conditions will not be affected.
